Releasing Protected Health Information Essay When it comes to the handling of patient’s records and them being released, it is not an easy process. It is very important for each patient that opts to have their information released for whatever reason sign a release form stating that they authorize their information being released. There are times in which a patient’s records can be released without having their authorization. In this case, the records can be requested from government agencies, legal agencies or a representative, and a research that may subpoena a medical profession for this information. Every person that becomes a patient in a healthcare facility is protected by something called HIPAA. The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a federal law passed by Congress that amended â€Å"the Internal Revenue Code of 1986 to improve portability and continuity of health insurance coverage in the group and individual markets, to combat waste, fraud, and abuse in health insurance and health care delivery, to promote the use of medical savings accounts, to improve access to long-term care services and coverage, to simplify the administration of health insurance, and for other purposes,† according to Essential of Healthcare Management (2011). HIPAA is a set of rules that address the use of privacy and confidentiality of an individual’s health records. Any facility that practices with the care of a patient is subject to the privacy rule of HIPAA. The covered entities would be considered privacy and disclosure of information as protected health information. The covered entity is required to obtain an individual’s authorization prior to disclosing any health information. Every patient when seen by a healthcare professional is made aware of their rights to how they want their medical information to be used. The reason for this is to keep patients information private and protected.  What it does allow is some information to be able to be transferred with the patient from physician to physician so that they the physician can know something about the patient to help them in the best way that they can. There are different circumstances by which agencies or covered entities have the right or legal obligation to access or obtain Patient’s Healthcare Information (PHI). PHI is under the HIPAA that gives the privacy regulation the privacy that should remain between the patient and doctor. Under some circumstances the gove rnment has the right or legal obligation to a patient’s medical records. Any health care data for analysis in support of policy, planning, regulatory or management functions, it is permitted to disclose information to other government agencies for health data systems (according to http://www.ncdhhs.gov/healthit/exchange/NCLaws_alignment.pdf). Any non-covered government entities may only maintain a limited amount of data sets of information. This is so that the identifiers (name, address and Social Security numbers) can be removed before the government agency receives them. When files are usually authorized to the law officials, it may be because the person can be a victim of domestic violence to a government authority, abuse, and neglect. In a case like the patient is informed that their information has been released unless the health facility believes that a serious harm will occur or the person may portray to themselves. Researchers may need to use files without being authorized to do so if they need to find a treatment for the person. Trying to receive the approval from a patient can be time consuming by which can getting a glimpse at the files and starting the job is much easier. I believe that no matter what kind of storage that is placed on medical records, it is secured and should be assessable when needed. Law official/ researchers are able to subpoena records due to research or something. I believe that they should be authorized to obtain records without a patient’s authority depending on the case. I believe that having records subpoena should go by a base-to-base case. I believe that privacy safeguards are adequate to support the law agencies, researchers, and government agencies of having them be able to obtain information about a patient even without their consent. I believe that in the long run, it makes it easier for some of these agencies to be able to do their job without any interruptions and debater. Before starting this class, I did not know as much as I do now. I believe that the HIPAA law  is something that protects patients from their PHI being exposed to the wrong people. The Controversial Issue of Doctor-Assisted Suicide      Ã‚   Imagine youu have just found out you are going to die within three months. Recently the questions have been changed form, "What am I going to do with the rest of my life?" to "When should I kill myself"?   With painful and crippling diseases such as AIDS and cancer, and Alzheimers along with doctors such as Dr. Kavorkian, some people are choosing death over life.   Doctor assisted suicide has been a very controversial subject in the past few years.   Some states such as Oregon have passed laws which allow doctors to prescribe lethal drugs to patients who have less then six months to live.(Henin 1)   Other state have taken the opposite side.   I believe that if you are able to reason and think rationally you should decide whether to live or dir.   If not the people who know you best should make the decision.      Ã‚  Ã‚  Ã‚   If you are ever in a situation where you now you wil soon die the choice whether or not to kill youself should be your own.   I believe that doctorassisted suicide should not be controlled by the government, but should be apersonal choice based on the individual.   Many people could not imagine living in a hospital bed for the remainder of their lives.   They would rather die with dignity than live out the rest of their lives depandant on others.   The government thinks that they know what is best for the people. If everyone is an individuall, how can the government know what is best for everyone.   I feel that people shold make up thir own minds about what is best for them.   Joshua Haney worote an article on assisted suicide.   He says, "Everyday we make choices tha... ...rite,s "We all di.   Death is a part of life. Death is inevitable.   Why should each of us not have the right to choose when and how we did; and if we are in no position to do so, why shoulld those who know us best not be allowed to help? The entire world is aware of the fact that Italy, France, England, and many others of European and Western origins were settlers in various places around the world, and these people established colonies in these nations, thereby influencing and impacting the nations’ people greatly. Take Italy, for example. This was a country that was among the last in Europe to start imperial expansion, probably because of the fact that the city-states were not united until the second half of the nineteenth century.Libya was one of the last few African territories that escaped colonization until the end of the nineteenth century, but its very proximity to Italy made sure that Libya was influenced in three major areas, like state formation, the modes of popular resistance, and the types of regimes that emerged after independence. (Bruce St John, Ronald (2004) Algeria was one of the countries that was subjected to heavy colonial influence. Areas like education, business, and so on were controll ed by the French for almost a hundred years, and the impact is felt in the country even today, in certain aspects of life in Algeria.(Algeria, Arabization 1993) It is important to remember that in Algeria and in Libya, colonial policies were shaped by the specific politics and economics prevalent in each European colonial state at the time, like for example in Italy, the colonial policy was a liberal one, recognizing local states of resistance. This factor enabled Libya to follow different modes of resistance. As far as Algeria was concerned, the French colonial policies were different, and in essence, it can safely be said that French colonization managed to destroy the pre-colonial state of Algeria (Ahmida, Abdullathif Ali 1994)Now, one can examine the state formation of Libya and Algeria, so that one can understand better how Italy and France influenced these two states in this aspect. State formation in these states is an issue of national consciousness. France encouraged Europe an colonization in Algeria from 1834 onwards, and Muslim lands were confiscated and in their place, a flourishing colony was created, completely separate from the Muslim majority. Muslims of the state emulated the popular form of resistance to European influence by proclaiming a war of independence, launching terrorist attacks against the French in the process.It was in 1962 that Charles de Gaulle was able to successfully proclaim independence for Algeria, and the Islamic Salvation Front enjoyed great popularity at the time because of its populist appeal. Violence, however, continues in Algeria to this day, and the majority of perpetrators are Muslim extremists. There is no peace in Algeria, and many experts feel that the European colonization, the subsequent fight for independence, the formation of the state, and eventually the regimes that emerged after independence may have influenced the state in an adverse manner. (Naylor C Phillip 2001)Most Libyans today would remember the fie rce fight for independence from colonization and escape from the all pervasive Italian influence. In 1970, Colonel Qaddafi managed to expel more than twenty thousand Italians who were living in Libya at the time, but today, Italy is one of Libya’s largest partners in trade. In 1988, Libya was implicated in an air crash in Lockerbie, Scotland, and subsequently, the UN has imposed sanctions on the country. When Qaddafi refused to comply with the sanctions, Libya became politically and economically isolated during the 1990’s.Illegal migration continues to this day, and recently, Italy had to pass an order to curb the phenomenon, but apparently, Libya has done nothing to implement it. Saif al-Islam, the son of Qaddafi, announced that he would sign a deal to compensate Libyans for thirty two years of Italian colonization. (Undoing the Damage 2008) In 2003, Libya showed its willingness to rid itself of weapons of mass destruction, and also of its missile program ‘Missi le Technology Control regime.’ (Background note, Libya 2007) Today, it can be said that although Libya and Algeria revolted against colonization, they did learn a few lessons from the Europeans, and their influence has lasted to this day. The countries maintain amicable relations with each other to this day, although rivalry and opposition does exist at all levels.
